Why German Payslips Are Legally Required

Under Section 108 of the Gewerbeordnung (GewO), every employer in Germany must provide employees with a written payslip -- the Gehaltsabrechnung -- for each pay period. This document must clearly itemise gross pay, every deduction, and net pay. Non-compliance can result in fines and disputes before the Arbeitsgericht (labour court).

German payslips are among the most detailed in Europe due to the country's multi-layered tax and social insurance system. Getting every line right is not optional.

Mandatory Fields on a German Payslip

A compliant Gehaltsabrechnung must include:

  • Employer name and address
  • Employee name, address, and personnel number
  • Tax ID (Steuer-ID) and tax class (Steuerklasse)
  • Social insurance number (Sozialversicherungsnummer)
  • Health insurance provider (Krankenkasse)
  • Pay period and payment date
  • Gross salary (Bruttogehalt)
  • Each individual deduction with amounts
  • Net salary (Nettogehalt)
  • Employer social insurance contributions (often shown separately)

Income Tax: Lohnsteuer

Germany uses a progressive income tax system. The employer withholds Lohnsteuer (wage tax) directly from the employee's gross pay based on their tax class and annual income.

The tax class (Steuerklasse I through VI) influences how allowances and thresholds are applied. For example, married couples can choose Class III/V or IV/IV combinations to optimise monthly withholding.

Solidarity Surcharge (Solidaritaetszuschlag)

The solidarity surcharge was largely abolished for most earners in 2021. It now applies only to higher incomes:

  • Rate: 5.5% of Lohnsteuer
  • Exemption: No surcharge if annual Lohnsteuer is below approximately 18,130 (single) or 36,260 (married filing jointly)
  • Partial surcharge applies in a transition zone above the exemption threshold

Church Tax (Kirchensteuer)

Employees who are registered members of a recognised church pay church tax:

Employees who are not church members do not pay this tax. Church membership status is recorded on the electronic tax card (ELStAM).

Social Insurance Contributions (Sozialversicherung)

Social insurance is the largest category of deductions in Germany. Contributions are split roughly equally between employer and employee:

Care insurance note: Childless employees over 23 pay an additional 0.6% surcharge (total employee share: 2.3%). Employees with two or more children receive reduced rates.

Total employee social insurance deductions typically range from 19.6% to 21% of gross salary, up to the contribution ceilings (Beitragsbemessungsgrenzen), which differ between western and eastern German states.
